General Terms and Conditions (GTC)

1. Scope

These General Terms and Conditions (GTC) apply to all orders placed via the SteinKunstWerk online shop.

A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activity (§ 13 BGB - German Civil Code).

An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or self-employed professional activity (§ 14 BGB - German Civil Code).

2. Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to order.

By completing the order, you submit a binding offer to conclude a purchase agreement.

The purchase agreement is concluded when we accept your order by order confirmation via email or by shipping the goods.

3. Right of Withdrawal

Consumers generally have a statutory right of withdrawal.

Exclusion of the right of withdrawal:
The right of withdrawal does not apply, according to § 312g para. 2 no. 1 BGB, to contracts for the supply of goods that are not prefabricated and for the production of which an individual choice or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.

This particularly applies to products that are custom-made only after an order and, due to their nature, cannot be easily reused or sold elsewhere.

If such an exclusion applies, it will be expressly indicated in the respective product offer.

Otherwise, the statutory right of withdrawal applies.

4. Prices and Payment Terms

All prices stated are total prices in accordance with §19 UStG (small business regulation). No VAT is shown.

Plus applicable shipping costs.

Payment is made via the payment methods offered at checkout. These will be displayed to you during the order process.

5. Delivery and Shipping

Delivery will be made to the address you provided during the order process.

We currently deliver within the European Union.

Self-collection of goods is not possible.

6. Retention of Title

The goods remain our property until full payment has been received.

7. Warranty (Liability for Defects)

For consumers, the statutory warranty rights apply.

For entrepreneurs, the warranty period for delivered goods is one year from the date of delivery of the goods.

8. Liability

We are liable without limitation for damages resulting from injury to life, body, or health, as well as for intent and gross negligence.

In the event of slight negligence in the breach of essential contractual obligations, we are only liable for foreseeable, typical damage.

Any further liability is excluded.

9. Contract Language

The contract language is German.

10. Applicable Law

German law applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

For consumers, this only applies insofar as the protection afforded by mandatory provisions of the law of the state in which the consumer has their habitual residence is not restricted thereby.
